1. Your failure to perform your fiduciary duties as trustees of my Agreement of Sale as detailed in the NOC delivered 9th February 2018 enclosing “Statement of Facts – Microcosm – Trustees Breaches of Trust” and as the humans as detailed in the enclosed “ Statement of Facts – Macrocosm – Natural Authority, Rights and Law”.

2. David Roberts has provided an inadequate response, and has failed to respond to additional specific information requested on the 9th February 2018 in response.

3.All other respondents failed to respond.

4. This is a breach of the NOTICE OF CLAIM – UNIT 609 AUSTIN HALL, OPPORTUNITY FOR REMEDY (hereinafter NOC)specifically FULL DISCLOSURE – Terms and Conditions, 4. YOUR REMEDY TO MY CLAIM IS TO ESTABLISH THE FACTS – Methods of Response.

The following information is required to be disclosed in order to try settle this matter.
1. As Austin Hall is still not practically completed how is it possible that both the Legal Charges in favour of Pinnacle Student Buyers (Leeds) Limited (PSBL) (one against the freehold and the other against Pinnacle Student Development (Leeds) Limited (PSDL) for the freehold title) were removed?
2. Please provide details of who signed to remove the Charge at the Land Registry and the date.
3. David Roberts confirmed his firm is no longer acting on behalf of PSDL, However they were acting on behalf of PSDL at the time of the sale of the freehold which could have only been done with the full knowledge that Austin Hall had not reached practical completion, and hence the sale is in breach of my Sales agreement.
​4. Tuscola and Grangeford Asset Management must have been acting in full knowledge of this breach as David Roberts stated Tuscola set up an Escrow account for the completion of the build  (which is included in the covenants in the Title Absolute). Please provide certified bank statements and invoices to confirm or deny this.(This is believed by David Roberts to be separate of about £1 million to repair defects on Asquith House). If this is not the case please provide certified bank statement showing the proceeds of the sale went into the trust account held by PSBL.
5. Knowing that the intent was to provide rental income to the investors, who authorised Urban Student Life to rent units in Austin Hall?
In accordance with  the NOC, specifically FULL DISCLOSURE – Terms and Conditions, 4. YOUR REMEDY TO MY CLAIM IS TO ESTABLISH THE FACTS – Methods of Response.
5. If you again fail to respond within 3 days (by midnight 22 February 2018) your inaction will result in a “Notice of Pre-Court Action, Opportunity to Cure Failure to Disclose Information and Notice of Lien”.

2. Please provide details of who signed to remove the Charge at the Land Registry and the date.
3. David Roberts confirmed his firm is no longer acting on behalf of PSDL, However they were acting on behalf of PSDL at the time of the sale of the freehold which could have only been done with the full knowledge that Austin Hall had not reached practical completion, and hence the sale is in breach of my Sales agreement.

Tuscola and Grangeford Asset Management must have been acting in full knowledge of this breach as David Roberts stated Tuscola set up an Escrow account for the completion of the build  (which is included in the covenants in the Title Absolute). Please provide certified bank statements and invoices to confirm or deny this.(This is believed by David Roberts to be separate of about £1 million to repair defects on Asquith House). If this is not the case please provide certified bank statement showing the proceeds of the sale went into the trust account held by PSBL.
5. Knowing that the intent was to provide rental income to the investors, who authorised Urban Student Life to rent units in Austin Hall?

1. Your failure to perform your fiduciary duties as trustees of my Agreement of Sale as detailed in the NOC delivered 9th February 2018 enclosing “Statement of Facts – Microcosm – Trustees Breaches of Trust” and as the humans as detailed in the enclosed “ Statement of Facts – Macrocosm – Natural Authority, Rights and Law”.

2. David Roberts has provided an inadequate response, and has failed to respond to additional specific information requested on the 9th February 2018 in response.

3.All other respondents failed to respond.

4. This is a breach of the NOTICE OF CLAIM – UNIT 609 AUSTIN HALL, OPPORTUNITY FOR REMEDY (hereinafter NOC)specifically FULL DISCLOSURE – Terms and Conditions, 4. YOUR REMEDY TO MY CLAIM IS TO ESTABLISH THE FACTS – Methods of Response.

The following information is required to be disclosed in order to try settle this matter.
1. As Austin Hall is still not practically completed how is it possible that both the Legal Charges in favour of Pinnacle Student Buyers (Leeds) Limited (PSBL) (one against the freehold and the other against Pinnacle Student Development (Leeds) Limited (PSDL) for the freehold title) were removed?
2. Please provide details of who signed to remove the Charge at the Land Registry and the date.
3. David Roberts confirmed his firm is no longer acting on behalf of PSDL, However they were acting on behalf of PSDL at the time of the sale of the freehold which could have only been done with the full knowledge that Austin Hall had not reached practical completion, and hence the sale is in breach of my Sales agreement.
​4. Tuscola and Grangeford Asset Management must have been acting in full knowledge of this breach as David Roberts stated Tuscola set up an Escrow account for the completion of the build  (which is included in the covenants in the Title Absolute). Please provide certified bank statements and invoices to confirm or deny this.(This is believed by David Roberts to be separate of about £1 million to repair defects on Asquith House). If this is not the case please provide certified bank statement showing the proceeds of the sale went into the trust account held by PSBL.
5. Knowing that the intent was to provide rental income to the investors, who authorised Urban Student Life to rent units in Austin Hall?
In accordance with  the NOC, specifically FULL DISCLOSURE – Terms and Conditions, 4. YOUR REMEDY TO MY CLAIM IS TO ESTABLISH THE FACTS – Methods of Response.
5. If you again fail to respond within 3 days (by midnight 22 February 2018) your inaction will result in a “Notice of Pre-Court Action, Opportunity to Cure Failure to Disclose Information and Notice of Lien”.

This error occurs because the sender sent a message to an email address hosted by Office 365 but the address is incorrect or doesn’t exist at the destination domain. The error is reported by the recipient domain’s email server, but most often it must be fixed by the person who sent the message. If the steps in the How to Fix It section above don’t fix the problem, and you’re the email admin for the recipient, try one or more of the following:

The email address exists and is correct – Confirm that the recipient address exists, is correct, and is accepting messages.

Synchronize your directories – If you have a hybrid environment and are using directory synchronization make sure the recipient’s email address is synced correctly in both Office 365 and in your on-premises directory.

Errant forwarding rule – Check for forwarding rules that aren’t behaving as expected. Forwarding can be set up by an admin via mail flow rules or mailbox forwarding address settings, or by the recipient via the Inbox Rules feature.

1. Your failure to perform your fiduciary duties as trustees of my Agreement of Sale as detailed in the NOC delivered 9th February 2018 enclosing “Statement of Facts – Microcosm – Trustees Breaches of Trust” and as the humans as detailed in the enclosed “ Statement of Facts – Macrocosm – Natural Authority, Rights and Law”.

2. David Roberts has provided an inadequate response, and has failed to respond to additional specific information requested on the 9th February 2018 in response.

3.All other respondents failed to respond.

4. This is a breach of the NOTICE OF CLAIM – UNIT 609 AUSTIN HALL, OPPORTUNITY FOR REMEDY (hereinafter NOC)specifically FULL DISCLOSURE – Terms and Conditions, 4. YOUR REMEDY TO MY CLAIM IS TO ESTABLISH THE FACTS – Methods of Response.

The following information is required to be disclosed in order to try settle this matter.
1. As Austin Hall is still not practically completed how is it possible that both the Legal Charges in favour of Pinnacle Student Buyers (Leeds) Limited (PSBL) (one against the freehold and the other against Pinnacle Student Development (Leeds) Limited (PSDL) for the freehold title) were removed?
2. Please provide details of who signed to remove the Charge at the Land Registry and the date.
3. David Roberts confirmed his firm is no longer acting on behalf of PSDL, However they were acting on behalf of PSDL at the time of the sale of the freehold which could have only been done with the full knowledge that Austin Hall had not reached practical completion, and hence the sale is in breach of my Sales agreement.
​4. Tuscola and Grangeford Asset Management must have been acting in full knowledge of this breach as David Roberts stated Tuscola set up an Escrow account for the completion of the build  (which is included in the covenants in the Title Absolute). Please provide certified bank statements and invoices to confirm or deny this.(This is believed by David Roberts to be separate of about £1 million to repair defects on Asquith House). If this is not the case please provide certified bank statement showing the proceeds of the sale went into the trust account held by PSBL.
5. Knowing that the intent was to provide rental income to the investors, who authorised Urban Student Life to rent units in Austin Hall?
In accordance with  the NOC, specifically FULL DISCLOSURE – Terms and Conditions, 4. YOUR REMEDY TO MY CLAIM IS TO ESTABLISH THE FACTS – Methods of Response.
5. If you again fail to respond within 3 days (by midnight 22 February 2018) your inaction will result in a “Notice of Pre-Court Action, Opportunity to Cure Failure to Disclose Information and Notice of Lien”.
